摘要
交通事故责任认定环节的存在对交通事故的处理带来了严重影响 :一是延长了事故处理过程 ;二是使公安机关交通管理部门陷入没有任何实际意义的事故责任认定与重新认定、甚至行政诉讼工作之中 ;三是严重影响了交通肇事刑事案件的办理 ,不利于打击交通肇事刑事犯罪 ;四是给交通事故当事人造成了不必要的麻烦 ,使之不能及时得到赔偿 ;五是对国家行政机关、司法机关的办案资源本身也是一种浪费。应当删去交通事故责任认定环节 ,修改相关法律法规 ,改变公安机关交通管理部门在事故处理中的职责。
The identification of liability in traffic accident has a great effect on the dealing of them in two aspects:1,the process of the dealings is prolonged;2,the traffic management departments are involved in the insignificant identification of the liability,re-identification and the administrative actions;3,the dealing of the traffic accident causing casualties is badly influenced,which harms the strike on the crime of causing traffic casualties;4,some unnecessary troubles are caused so that the concerned parties cannot be compensated in time;5,it is a great waste to the administrative organs an the judicial ones.Therefore,the concerned laws should be amended to abrogate the identification and to change the duties of the traffic management departments in dealing with the traffic accidents.
