摘要
足球“黑哨”已成为国人瞩目的热点话题,“黑哨”行为究竟是否构成犯罪和构成什 么犯罪在法学界引起了一场不大不小的争论。笔者认为“黑哨”行为符合受贿罪的四大构成要件, 构成受贿罪。足球市场也需法律干预。
The unfair judge,which is called'black whistle',has been the hot topic to Chinese people. Whether the 'black whistle' forms the crime or not and what crime it is has caused a big stir in the law circle. The author thinks the referee's black whistle comforns to the forming factors of crime of taking bribes.
