摘要
医疗事故的鉴定是确定医疗事故责任的关键。应当克服目前由卫生行政管理部门和医学会两者包办医疗事故技术鉴定而形成的弊端 ,以立法的形式明确规定医疗事故鉴定由公安机关主持并负责组建 。
The appraisement for medical accidents is the key to confirm the responsibilities of medical accidents. But the present malpractice caused by both the Sanitary Administrative Organs and Medical society's monopolizing medical accidents' technical appraisement should be overcome. Medical accidents' appraisement should be charged by Public Security Organizations, which must be prescribed clearly in the law. Medical units should withdraw from preservation of medical records that have influence on confirmation of accidents.
