摘要
社会稳定是一切社会生活正常进行的必要前提,而犯罪直接影响到社会的稳定,国家制定刑事政策的目的正是希望通过预防和控制犯罪以达到维护社会稳定这一终极目标,反过来刑事政策的内容又受到犯罪和社会稳定之规律性的制约。刑事政策的制定必须遵循这三者的辩证关系方可奠基于科学的根基之上。
Social stability is the essential prerequisite of the normal proceeding of all the social lives, while the crime affects social stability directly. With the hope of attaining the ultimalte goal of social stability, the state enacts penal policy and in turn the contents of penal policy are restricted by the regularity of crime and social stability. The enactment of penal policy must follow the dialectical interaction among these three aspects , only by which can a scientific basis be laid.
