摘要
从实证法学的立场出发 ,本文粗略地论述了法学的三个特征 :法学是一门实用性 (实践性 )学科 ;是一门以对法律的理解为主要内容的学科 ;是一门带有很强教义学属性的学科。基于对法学这三个特点的认识 ,作者认为我国法学应进行研究范式的四个转向 ,即立法中心主义立场向司法中心主义的转向 ;研究内容从本体论向方法论的转向 ;研究的价值趋势由单一的阶级意志向价值多元的转向 ;
On the position of legal positivism, the article has argued roughly the characteistics of legal theory, that is, it is a practical and strong dogmatic principle, whose contents relate to law's understanding. On the basis of such arguments, the author claims the contemporary legal theory ought to change its research paradigms on four aspects: from legislative center to judicial one, from ontology to methodology, from solely class wills' value to value pluralism, and from integrated approach to individual one.
