摘要
分析了当前社会转型时期我国夫妻人身关系出现了婚外性关系日益蔓延、夫妻暴力较为严重、生育纠纷问题时有发生等突出问题,在分析其产生原因及其危害性以及目前我国有关夫妻人身关系立法及执法机制不健全的基础上,提出了完善我国夫妻人身关系法律调控机制必须从立法和执法方面采取措施,并对完善我国夫妻人身关系的立法和执法措施提出了基本构想。
This paper analyses some present prominent matters if physical relation of couple, such as the increasingly spreading of unofficial sexual intercourse, the obvious seriousness of the conjugal violence and the consantly happening of the birth dispute during the social period in transition. On the basis of analysing their causes and harmfulness and the imperfection of legistation and law enforcement mechanism, a proposal is put forward that measures should be taken to consummate the mechanism of law adjustment from the points of legistation and law enforcement, and, some basic thoughls are also raised.
