摘要
在立法体例上,宪法监督制度有最高国家权力机关或立法机关监督制、司法机关监督制和专门机关监督制三种模式。我国现行宪法监督制度存在着不足与缺陷,根据我国国情,应当采纳专门机关监督模式,设立专门的宪法监督机构,即独立的宪法委员会,有效地审查和纠正违宪行为,以完善我国的宪法运行机制,充分发挥宪法的作用。
There are three kinds of constitution supervision models in the world,namely,supervision from parliament or from supreme organ of state power,supervision from common court and supervision from a special one.There are obvious defects in the existing constitutional supervision system.According to China's current situation,we should adopt the special agency supervision system and establish the special constitution supervision organ--the independent constitutional committee so as to perfect the constitutional operating system and fulfill the role of constitution.
