摘要
知情同意权作为医患关系中患者一方最基本的权利正受到患者认知能力的严重影响 ,这一方面是原本专业化医学正在逐步走向专门化原因造成的 ,但与医患关系、文化传统、知识水平等因素也有着千丝万缕的联系。正确处理知情权与患者认知能力之间的关系对于衡平医患关系、维护医患双方权益有着重大的现实意义。问题既有赖于医患双方的协力 ;更要依靠社会各方面合作 ,形成合力加以解决。
As the basic right of patients side in the relationship between doctors and patients, informed consent is now influenced by the recognition ability of patients.On one hand,because the original professional medical science is becoming more and more special;on the other hand,it has also some connection with the factors such as the relationship between doctors and patients, culture tradition, knowledge level,etc.The Proper handling of the relationship between informed consent and recognition ability of patients has great practical significance to balance the relationship between doctors and patients and protect the benefits of two sides. The solving of this problem depends not only on the cooperation of doctors and patients but on the cooperation of all around of society to join forces.
