摘要
植物新品种权是种业领域最重要的知识产权。基于农业农村部科技发展中心公布的植物新品种权申请及授权数据,系统梳理2004—2024年海南省农业植物新品种权的申请与授权概况,细化分析不同主体、不同作物类型的相关申请和授权情况。研究发现当前存在植物新品种权保护意识薄弱、授权比例较低、品种结构不均衡合理及侵权现象时有发生等问题。据此,从强化育种者权益认知、提升审查授权效能、优化品种结构布局、加大侵权执法力度等维度提出对策,为推动海南省种业高质量发展提供参考依据。
Plant variety rights(PVR)constitute a core form of intellectual property in the seed industry.Based on application and grant data released by the Development Center of Science and Technology of the Ministry of Agriculture and Rural Affairs,this study systematically reviewed the overall status of agricultural PVR applications and grants in Hainan Province from 2004 to 2024.A detailed analysis was conducted across different applicant entities and crop categories.The findings revealed several existing challenges,including limited awareness of PVR protection,a relatively low grant rate,an imbalanced variety structure,and recurring infringement incidents.Accordingly,this paper proposed countermeasures from multiple perspectives,including strengthening breeders'awareness of rights protection,enhancing the efficiency of examination and grant procedures,optimizing the variety structure and distribution,and intensifying law enforcement against infringements.This study aims to provide a practical reference for promoting the high-quality development of the seed industry in Hainan Province.
