摘要
《中华人民共和国监察法》已经完成修改,但是仍未破解职务犯罪案件面临的监察机关和检察机关衔接适用认罪认罚从宽制度的现实困境。究其原因,《中华人民共和国监察法》与《中华人民共和国刑事诉讼法》在认罪认罚从宽的实体条件、程序设计、证据规则及处罚建议效力等方面的规定存在差异,由此导致监检衔接不畅,进而影响制度的统一适用与实践效果。为此,未来应当从监察机关和检察机关相互配合与相互制约的工作原则出发,从统一从宽处罚的基准要件、规范从宽认定的程序流转、释明从宽证据的证明标准、明确从宽建议的法律地位等方面进行体系化建构,实现认罪认罚从宽制度在职务犯罪案件中的有序衔接,提升反腐败工作的规范化法治化正规化水平。
The Supervision Law of the People’s Republic of China has been revised,but it still fails to solve the practical difficulties faced by supervisory organs and procuratorial organs in the application of the leniency system for guilty pleas and punishment acceptance in cases of duty-related crimes.The reason lies in the differences between the Supervision Law of the People’s Republic of China and the Criminal Procedure Law of the People’s Republic of China in terms of the substantive conditions,procedural design,evidence rules,and the legal effect of leniency suggestions.This has led to poor coordination between the supervisory and procuratorial organs,and has affected the uniform application and practical effect of the system.Therefore,in the future,it is necessary to start from the principle of mutual cooperation and mutual restraint between supervisory and procuratorial organs,and carry out systematic construction from aspects such as unifying the benchmark conditions for leniency,standardizing the procedural flow of leniency determination,clarifying the proof standards for leniency evidence,and clarifying the legal status of leniency suggestions,to achieve orderly coordination of the leniency system for guilty pleas and punishment acceptance in cases of duty-related crimes,and enhance the standardization,legalization and regularization of anti-corruption work.
