摘要
岳麓书院所藏秦简有两个问题值得探讨:一是关于汉初萧何改造秦律令制定汉律令的家族法,岳麓秦令中有关于侵犯尊亲属令文等资料,涉及秦代家族、赘婿、乡里等法律关系,可作为汉初萧何改造秦律令制定汉律令的家族法具体例证。此外,睡虎地秦简附抄魏《户律》《奔命律》中所见“叚门逆旅”“赘婿后父”与岳麓秦简秦律令中的“赘婿”“入姨夫”诸词含义再次得到审视;二是关于陈胜吴广“失期当斩”,岳麓秦简(伍)中可见诣风雨、疾病等不可抗力因素可报官陈情免除或减轻刑罚的法令。
There are two issues worth exploring regarding the Qin bamboo slips collected at Yuelu Academy:First,regarding the family law in the Han law and order formulated by Xiao He in the early Han Dynasty through the reform of the Qin law and order,the Qin law and order collected at Yuelu Academy contain materials such as provisions on infringing upon the honor of relatives,involving legal relationships such as family,uxorilocal marriage,and village in the Qin Dynasty,which can serve as specific examples of the family law in the Han law and order formulated by Xiao He in the early Han Dynasty through the reform of the Qin law and order.In addition,the meanings of terms such as“merchants or innkeepers(叚门逆旅)”and“husbands or fathers-in-law of a uxorilocal marriage(赘婿后父)”found in the Qin bamboo slips unearthed at Shuihudi,which are copied from the Household Law《户律》and Laws for Individuals Running for Survival《奔命律》of the State of Wei,and terms such as“husbands of a uxorilocal marriage(赘婿)”and“uncle of a uxorilocal marriage(入姨夫)”found in the Qin bamboo slips collected at Yuelu Academy,have been re-examined.Second,regarding the issue of Chen Sheng and Wu Guang“being beheaded according to the law for failing to meet the deadline”,it can be seen in the Yue Lu Qin bamboo slips(Volume 5)that in the event of force majeure factors such as wind,rain,illness,etc.,one can report to the authorities and request exemption or reduction of punishment.
