摘要
近年来,加处罚款类案件在行政非诉执行案件中呈现出占比大、问题多的特点,尤其是在加处罚款减免问题上,囿于行政强制法条款的设置、全国人大常委会法工委答复意见的制约及人民法院执行权限的限制等因素,加处罚款的减免存在着严重的“梗阻”,既影响执行效率,也存在国有财产流失的风险。从行政强制法的立法目的考量,发现在行政非诉执行阶段减免加处罚款具有合法性,有利于实质化解行政纠纷。加处罚款减免的适用,应当在行政相对人积极采取补救措施,行政机关全面审查,程序合法的基础上作出减免处罚,建立“府检联动”机制,推动检察机关“审慎”依法监督,完善行政非诉执行案件中加处罚款减免制度,规范加处罚款减免的执法司法标准,实现法律监督质效的全面提升。
In recent years,cases involving additional fines have accounted for a significant proportion of non-litigation administrative enforcement cases,presenting numerous challenges.Particularly concerning the reduction or exemption of such fines,severe obstacles exist due to constraints imposed by provisions in the Administrative Compulsory Law,responses from the Legislative Affairs Commission of the NPC Standing Committee,and limitations on the enforcement authority of people’s courts.These barriers not only hinder enforcement efficiency but also pose risks of state asset loss.Considering the legislative purpose of the Administrative Compulsory Law,reducing or exempting additional fines during the non-litigation enforcement phase is legally justified and conducive to substantively resolving administrative disputes.The application of penalty reduction should adhere to the following principles:administrative counterparts must actively implement remedial measures;administrative agencies must conduct comprehensive reviews;reductions should be granted based on procedural legitimacy;a“government-prosecutor coordination”mechanism should be established;procuratorial organs should exercise“prudent”legal oversight;the penalty reduction system in non-litigation administrative enforcement cases should be refined;and law enforcement and judicial standards for penalty reduction should be standardized.These measures will comprehensively enhance the quality and effectiveness of legal oversight.
