摘要
加强中国特色行政检察制度建设是坚持和完善作为我国根本政治制度的人民代表大会制度的需要,是坚持和完善中国特色社会主义法治体系,建设法治国家、法治政府、法治社会,推进国家治理体系和治理能力现代化的需要,是坚持和完善党和国家监督体系,强化对公权力运行制约和监督的需要。新时代行政检察的范围主要包括三大类别:行政诉讼检察监督,行政判决、裁定执行和非诉执行的检察监督,以及对违法行政行为的检察监督。新时代行政检察不仅要注重监督人民法院依法进行行政审判,监督行政机关依法行政和保护公民、法人和其他组织合法权益,保护国家、社会公共利益目标的实现,而且应注重促进行政争议实质性化解,维护社会关系和谐稳定目标的实现。
Strengthening the construction of the administrative procuratorial system with Chinese characteristics is the need to uphold and improve the people’s congress system as China’s fundamental political system.It is also the need to uphold and improve the socialist rule of law system with Chinese characteristics,to build a country ruled by law,a government ruled by law,and a society ruled by law.It is also necessary for the need of upholding and improving the party and state supervision system,as well as strengthening the restriction and supervision of the operation of public power.The administrative procuratorial work in the new era mainly includes three categories:the procuratorial supervision of administrative litigation;the procuratorial supervision of administrative judgment,ruling execution and non-litigation enforcement;and the procuratorial supervision of illegal administrative acts.The administrative procuratorial work in the new era should not only pay attention to the supervision of legality of the court’s administrative trials,the justification of the administrative organs’administration,and the realization of the citizen’s legitimate rights and interests,but also pay attention to the promote the substantive resolution of administrative disputes.It should protect not only the realization of the goal of the national and social public interests,but also the realization of the goal of keeping harmonious and stable social relations.
