人工智能时代民事诉讼当事人的数字权利建构

The Construction of digital rights for civil litigation parties in the Era of artificial intelligence

摘要 人工智能技术深度嵌入民事诉讼,引发当事人程序权利保障的深刻变革,但现有法律对当事人的数字权利形态界定模糊。本文对人工智能时代民事诉讼当事人的数字权利进行规范界定:该权利是当事人对“诉讼关联数据”享有的保障程序公平的权利集合,具有诉讼程序依附性与权利行使同步性的核心特质。通过剖析立法供给存在的碎片化与空白化困境,以程序正义为逻辑主轴,构建了以算法透明为前提的“数字知情权”,以意思自治为保障的“数字控制权”,以技术风险矫正为目标的“数字救济权”,形成三位一体保障体系,为完善相关制度设计、回应技术挑战、维护数字时代的司法公正提供坚实的理论支撑。 Artificial intelligence technology is deeply embedded in civil litigation,triggering profound changes in the protection of the procedural rights of the parties.However,the current laws have a vague definition of the digital rights forms of the parties.The research standardizes and defines the digital rights of civil litigation parties in the era of artificial intelligence,revealing that this right is a collection of rights that the parties enjoy over"litigation-related data"to ensure procedural fairness,and it has the core characteristics of procedural dependence in litigation and synchronous exercise of rights.By analyzing the fragmented and blank predicament existing in legislative supply,with procedural justice as the logical main axis,a"digital right to know"based on algorithm transparency,a"digital control right"guaranteed by autonomy of will,and a"digital relief right"aimed at correcting technical risks have been constructed,forming a three-in-one guarantee system.To provide a solid theoretical support for improving the relevant institutional design,responding to technical challenges,and maintaining judicial justice in the digital age.
