摘要
社会组织监管作为规范社会组织运作、塑造其发展环境的法律框架,核心在于根据不同类型社会组织的特征合理配置相应的监管工具,并通过制度设计引导激励多元监管主体协同参与。然而,既有研究一度把监管工具当作中心问题,却无视监管的治理。本研究将社会组织监管看作一个政策整合的政治过程,采用类型学分析方法,构建起协同赋权型、精准防控型、弹性自主型、垂直统合型等四种监管模式,并对不同监管模式的适用条件进行横向比较。整合监管主体和监管工具两个基础维度的社会组织分类监管思路,能够协调来自不同子系统的监管主体,组合来自不同部门的监管工具,并安排与其一致的实施和评估,有利于社会组织实现高质量发展。
As a legal framework for shaping the operational ecology of social organizations,social organization regulation involves adopting appropriate regulatory tools for different types of social organizations downstream,and seeking governance mechanisms that incentivize diverse regulatory entities to create and operate high-quality regulatory systems upstream.However,existing studies have once regarded regulatory tools as the central issue,ignoring the governance of regulation.This study regards the classification and regulation of social organizations as a political process of policy integration,and adopts typological analysis methods to construct four types of regulatory models:collaborative empowerment,precise prevention and control,flexible autonomy,and vertical integration,and horizontally compared the applicable conditions of different regulatory models.The social organization classification supervision approach that integrates the two basic dimensions of regulatory entities and regulatory tools enables coordination among regulatory entities across multiple subsystems,the combination of regulatory tools from different departments,and the alignment of implementation and evaluation mechanism.Such an integrated regulatory framework is conducive to the high-quality development of social organizations.
