摘要
作为一种新型违法犯罪行为,“开盒挂人”型网络暴力既包括上游非法获取公民个人信息的行为,也包括下游的网络暴力行为,因而亟须一体化治理。在该类行为的刑法规制中,既要加强个体的责任,也要强化作为网络服务提供者之平台的义务与责任。对于个体行为的刑法规制,应当区分未公开和已公开的个人信息,合理界定上游侵犯公民个人信息行为的规制边界;推动治理范式的转型,破解“法不责众”的难题,平衡言论自由与网络监管之间的张力。对于网络服务提供者的刑法规制,应明确其仅在例外情形负有主动监管义务,并重点强化其被动监管义务,构建用户友好型的投诉机制,明确规定其对违法内容采取必要措施的期限。同时,应适度激活拒不履行信息网络安全管理义务罪的司法适用。
As an emerging form of unlawful conduct,“doxxing and online shaming”represents a dual-layered phenomenon:the upstream unlawful acquisition of citizens personal information and the downstream perpetration of online abuse.Addressing this issue requires an integrated governance framework.From the perspective of criminal regulation,emphasis should be placed not only on strengthening individual liability but also on clarifying and reinforcing the obligations of online service providers.Regulation of individual conduct calls for distinguishing between unpublished and publicly available personal information,thereby delineating the boundaries of criminal liability for upstream infringements.A paradigm shift toward coordinated administrative criminal enforcement is needed to overcome the dilemma of“the law does not punish the multitude”,while balancing the tension between freedom of expression and online regulation.Regarding platform responsibility,proactive monitoring obligations should be confined to exceptional circumstances,whereas passive monitoring duties should be enhanced.This includes establishing user-friendly complaint mechanisms and specifying clear timeframes for removing unlawful content.In addition,the judicial application of the offense of refusal to perform information network security management obligations should be appropriately revitalized.
