摘要
随着我国知识产权海关执法制度不断完善,自贸区知识产权海关执法和保护水平明显提升,但同时也存在知识产权纠纷类型各异、知识产权纠纷技术性强等问题。通过完善统一自贸区知识产权海关执法措施的法律依据,扩大和调整自贸区知识产权保护范围和模式,制定适应自贸区发展需求的海关监管措施,优化自贸区知识产权海关执法体制。提出健全自贸区知识产权海关保护法律及执法体系;推进跨部门联合执法,协同打击侵权行为;注重关企合作,帮助出口企业维护知识产权;建设数字围网,实现依法科学监管;建设与数字贸易监管相适应的智慧海关等自贸区知识产权海关执法措施改革建议,有效提升自贸区知识产权海关保护水平。
With the continuous improvement of the IPR customs enforcement system in China,the level of IPR cus⁃toms enforcement and protection in the FTAs has significantly.However,it also faces issues such as various types of IPR disputes and the strong technical nature of IPR disputes.This paper proposes to improve the legal basis for unified I customs enforcement measures in FTAs,expand and adjust the scope and mode of IPR protection in FTAs,formulate customs supervision measures to meet the needs of FTA development,and optimize the IPR cus⁃toms enforcement system in FTAs.This paper also proposes the following reform suggestions for the measures of IPR customs enforcement in FTAs:to improve the legal and system for IPR customs protection in FTAs;to promote cross-departmental joint law enforcement to coordinate the combating of infringement;to pay attention to coopera⁃tion between customs and to help export enterprises safeguard their IPRs;to build a digital fence to achieve scien⁃tific supervision according to law;to build a smart customs adapted to digital trade supervision and other measures As a result,the level of IPR customs protection in FTAs is effectively improved.
