摘要
针对一起无证生产饲料的典型案例,系统评析了其办案质量。该案件在主体认定、调查取证、法律适用、时限遵守及权利保障等环节均符合规范要求:执法机关准确认定某农产品公司为责任主体,全面收集了委托生产合同、资金往来凭证等关键证据,正确适用《饲料和饲料添加剂管理条例》进行定性处罚,程序时限合规,并充分履行了听证告知等义务。该案虽具示范意义,但也警示执法人员,执法实践中需在追求实体公正的同时,进一步强化程序规范与文书说理,以全面提升行政处罚的质量与公信力。
The quality of handling of a typical case of unlicensed production of pig feed was systematically analyzed.Identification of liable entity,investigation and evidence collection,law application,compliance with time limits,protection of rights and other links related to the case complied with regulatory requirements.Specifically,an agricultural company was accurately identified as the liable entity by law enforcement authority,key evidences including entrusted production contract and fund transaction documents were comprehensively collected,the Regulations on the Administration of Feed and Feed Additives was correctly applied for characterization and penalty imposition,the procedural timeline was compliant with requirements,obligations such as hearing notifications were fully fulfilled.The case could be used as a model and an alert that procedural standards and reasoning in legal documents should be strengthened by enforcement personnel when they were pursuing substantive justice,to comprehensively improve the quality and credibility of administrative punishments.
