摘要
全民所有自然资源资产所有权委托代理机制是对自然资源国家所有权行使模式和实现形式的创新。民事委托、行政委托或者新型委托关系说,没有揭示出所有权委托代理机制的本质属性,不能有效解决名义取得和责任归属等问题。因此,需要研究所有权委托代理机制的法律属性、法律内容和法律构造。所有权委托代理机制系属行政授权,其客体是所有者职责,是所有者职责在央地之间的第二次分配。行政授权引起所有者职责的层级转移,应当有授权法根据。
The principal-agent mechanism for State-Owned Natural Resources Assets represents an innovative approach to the exercise and realization of state ownership over natural resources.Existing theories—including civil entrustment,administrative delegation,and novel principal-agent frameworks—fail to capture the essential nature of this ownership-based agency mechanism,nor can they effectively address the critical issues of subject status and liability attribution.Consequently,a comprehensive analysis is required to clarify the legal nature,content,and structural framework of this ownership agency system.The ownership agency mechanism operates under the legal principle of administrative authorization,with its core focus being the secondaryallocation of proprietary responsibilities between the central government and local governments.By enabling hierarchical transfers of ownership-related obligations,administrative authorization must adhere to the principle of legal reservation,ensuring that all delegations are firmly grounded in statutory authority.
