摘要
《中华人民共和国医疗保障法》作为我国医疗保障领域的基本法,立法目标是健全多层次的医疗保障体系,通过规范相关行政主体之间以及行政主体与相对人之间的法律关系,实现公民的医疗保障权。该法应当秉承管理法的功能定位,发挥整合各项制度和协调政府各部门职能的作用,构建合理的内部体系和结构。目前,浙江、江苏、上海三个省市已经颁布相关的地方性法规,有必要通过“提取公因式”的方式凝聚共识。“十五五”时期,建议将医疗保障体系框架内各项制度的地位和衔接机制、基金安全平稳运行的举措,以及对定点医药机构和参保人行为的要求、多方主体的监督措施和协同机制、规范统一的公共服务和医药管理制度,作为中央层面立法的核心内容;将建立新型险种、实现医疗信息数据共享和保障特殊患者群体权益,作为特色内容;删减一些地方性制度,促进医疗保障制度在全国范围内平等实施。
As the fundamental law governing China's healthcare security sector,the Healthcare Security Law aims to establish a multi-tiered healthcare security system.By regulating legal relationships among relevant administrative entities and between administrative bodies and their counterparts,it seeks to realize citizens'right to healthcare security.This law should uphold its functional role as a management law,serving to integrate various systems and coordinate the functions of government departments to construct a rational internal framework and structure.Currently,Zhejiang,Jiangsu,and Shanghai have enacted relevant local regulations.It is necessary to consolidate consensus through a process of"extracting common factors."During the 15th Five-Year Plan period,it is recommended that the following elements form the core content of central-level legislation:the status and coordination mechanisms of various systems within the healthcare security framework;measures for the safe and stable operation of funds;requirements for designated medical institutions and insured individuals;supervision measures and coordination mechanisms involving multiple stakeholders;and standardized public services and pharmaceutical management systems.Establishing new insurance types,achieving medical information data sharing,and safeguarding the rights of special patient groups should be treated as distinctive features.Certain regionally specific provisions should be streamlined to promote equitable implementation of the healthcare security system nationwide.
