The Dual Positioning of Rural Collective Economic Organizations:Theoretical Interpretation,Internal Tension and Adaptation Approach

摘要我国农村集体经济组织是兼具公私面向的综合型功能组织与特殊经济组织。功能定位上,它并非是单一功能型组织,而是承担了经济、社会、文化等多元功能,具有公的面向;市场定位上,它具有独立的市场主体地位,蕴含私的要素。公私交织下的双重定位使农村集体经济组织在内部成员、集体财产以及市场竞争方面存在鲜明的张力:综合功能定位要求成员的封闭、财产的固定及竞争上的依附性,而市场主体定位强调组织成员的有限开放、集体财产的适度流动以及市场竞争的独立自主。针对公私间的张力,应厘定关系类型,区分集体成员与农村集体经济组织成员、成员身份资格与利益属性、财产本身与财产收益;推进内外共治,在竞争模式与成员认定上通过自治探索、管治兜底的方式,优化共治样态;畅通救济渠道,捋顺不同救济途径之间的顺序,完善诉讼救济的制度构造。 Rural collective economic organization in China is a comprehensive functional and special economic entity with both public and private dimensions.In terms of functional positioning,it is not a single-functional organization,but undertakes economic,social,cultural and other multiple roles,reflecting a public nature;with regard to market positioning,it has the status of an independent market subject,which reveals the private elements.The dual positioning of public and private intertwining makes the rural collective economic organization in the internal members,collective property and market competition in the existence of distinct tension.The comprehensive functional positioning requires confined members,fixed property and competitive adherence,whereas the positioning of the market emphasizes the limited openness of membership,moderate flow of the collective assets as well as the independence and autonomy of the market competition.To address the tension between the public and private sectors,it is necessary to define the type of relationship,differentiate between collective members and members of rural collective economic organizations,membership qualification and interest attributes,property itself and property income.Furthermore,promoting internal and external co-governance and optimizing the pattern of cooperation requires self-governance exploration and governance safeguards in the competition mode and identification of members.Additionally,it should facilitate to smooth the channels of redress by smoothing out the order of the different redress routes and perfecting the institutional structure of litigation redress.
