数字时代虚拟设计专利保护的路径研究

摘要 数字技术的深入发展催生出以全息投影等非实体媒介为载体的新型虚拟设计。外观设计专利制度保护具有美感的设计,而非产品的实体物质形态。设计与产品可在概念认知和物理存在两个层面实现分离。我国外观设计专利制度演进呈现出产品依附性弱化的发展态势,虚拟设计形态则通过突破产品物理轮廓限制表现为数字化的三维图影形状。建议从两个维度完善虚拟设计的专利保护:一是区分外观设计中产品与载体的概念差异,明确产品仅作为载体的表现形式之一,肯认非实体媒介的设计载体地位;二是构建类型化保护体系,将虚拟设计确立为独立于产品设计的外观设计专利客体新类型。 With the rapid advancement of digital technologies,novel forms of virtual design have emerged,characterized by their reliance on non-physical media such as holographic projection as carriers.The fundamental aim of the design patent system is to protect the aesthetic aspects of a design rather than the tangible,material form of a product.In this context,design and product can be conceptually and physically decoupled.The evolution of China's design patent regime reflects a diminishing dependence on physical products as carriers.Virtual designs,by transcending the spatial boundaries of tangible products,are increasingly manifested as digitized three-dimensional graphical representations.In light of this shift,this paper proposes a two-dimensional framework for improving the patent protection of virtual designs.First,it is necessary to distinguish between the concepts of"product"and"carrier"within the scope of design protection.The product should be understood as merely one of multiple possible forms through which a design may be expressed,thereby affirming the legitimacy of non-physical media as carriers of design.Second,a typological protection system should be established,recognizing virtual designs as a new and independent category of subject matter within design patent law,distinct from conventional product-based designs.
