摘要
数字社会中,大型数字平台凭借对算法决策权、数据控制权与认知塑造权的垄断性掌控形成具有广泛社会规制力的准公权力,其技术私有化根基与公共治理属性间的张力引发目标异化、程序异化与责任异化危机。异化效应通过复杂传导机制对政治安全、经济安全、社会安全及国防安全等国家安全领域构成代际挑战。传统规制体系因主体错配、规则错配与工具错配而深度失效。亟需构建国家安全导向的法律规制新范式:通过承认平台“类国家行为体”地位建立“新分权制衡”体系;实施准入限制、过程规训与后果救济三阶防控;立足中国制度禀赋实施动态敏捷治理。最终建立权责统一、透明可控的数字权力运行机制,筑牢国家安全屏障并支撑可持续数字文明秩序。
In the digital society,large technology platforms monopolize algorithmic decision-making power,data control power,and cognitive shaping power,forming a quasi-public authority with extensive social regulatory influence.The tension between their technologically privatized foundations and public governance attributes triggers crises of goal alienation,procedural alienation,and accountability alienation.These alienating effects pose intergenerational challenges to national security domains-including political security,economic security,social security,and defense security—through complex transmission mechanisms.Traditional regulatory systems have profoundly failed due to subject mismatch,rule mismatch,and tool mismatch.There is an urgent need to construct a new national security-oriented legal regulatory paradigm:by acknowledging platforms as"state-like actors"to establish a"neo-separation of powers"system;implementing a three-phase regulatory chain of access restrictions,process discipline,and consequence remediation;and leveraging China's institutional endowments to execute dynamic agile governance.This paradigm aims to create a unified,transparent,and controllable digital power-operating mechanism,fortifying national security barriers and supporting a sustainable digital civilization order.
