摘要
企业环境责任作为经济法律体系的重要组成部分,关乎生态文明建设与绿色发展。当前企业环境责任在实践中面临排放标准模糊、监管执法程序不统一、信息披露制度不完善等现实困境。为破解这一困境,文章提出以下规范化路径:在执行层面,通过制定污染物排放限值标准、统一环境保护设施技术标准、建立监管执法检查制度、健全违法行为报告机制、完善环境信息公开制度;在法律保障层面,要明确行政处罚适用规则、确定民事损害赔偿方法、追究严重违法刑事责任、规定生态损害修复方式、实施信用惩戒联动措施等,形成全链条责任追究与多元化司法救济格局。
As a crucial component of the economic legal system,corporate environmental responsibility is vital for ecological civilization construction and green development.Currently,the implementation of corporate environmental responsibility faces practical such challenges as ambiguous emission standards,inconsistent regulatory enforcement procedures,and inadequate information disclosure systems.To address these issues,this study proposes the following standardization pathways:at the implementation level,by establishing pollutant emission limit standards,unifying technical standards for environmental protection facilities,creating a regulatory enforcement inspection system,improving violation reporting mechanisms,and enhancing environmental information disclosure systems;at the legal safeguard level,by clarifying administrative penalty rules,defining methods for civil compensation,pursuing criminal liability for severe violations,stipulating ecological damage remediation measures,and implementing credit punishment mechanisms.These efforts aim to establish a comprehensive accountability chain and a diversified judicial relief framework.
