摘要
低空经济作为新兴综合性经济形态,展现出巨大发展潜力。当前我国已初步构建以《民用航空法》为核心的低空经济法律体系,但在实践层面仍面临涉及空域使用与空间管理法律界定不清、权益分配机制不清晰等具有系统重要性的关键问题,需要从法律概念界定的基础逻辑出发加以厘清。空域权主要涉及民事主体占有、使用空域资源并获取收益的合法权益,空间权则体现国家对空域资源的公法性管理权限。明确二者的概念内涵与相关边界,有助于解决空域资源产权界定等实践中的前置性问题,在提升空域资源配置效率的同时,实现安全与发展的动态平衡。应在立法顶层设计层面厘清空域权与空间权的法律属性,系统构建空域权益分配制度,在完善低空经济配套保障机制的过程中发挥法律化解资源分配矛盾的积极作用,推动低空经济高质量发展。
As an emerging comprehensive economic form,the low-altitude economy has demonstrated significant potential for development.Currently,China has initially established a legal system for the low-altitude economy centered around the Civil Aviation Law.However,at the practical level,key issues of systemic importance remain,such as unclear legal definitions regarding airspace usage and spatial management,and an unclear rights distribution mechanism.These issues need to be clarified starting from the fundamental logic of legal concept definition.Airspace rights mainly involve the legitimate rights and interests of civil subjects in occupying,using airspace resources,and obtaining benefits,while spatial rights reflect the state's public law management authority over airspace resources.Clarifying the conceptual connotations and related boundaries of the two is conducive to resolving the preconditions such as the definition of airspace resource property rights in practice.It can enhance the efficiency of airspace resource allocation while achieving a dynamic balance between safety and development.At the top-level design of legislation,the legal attributes of spatial rights and airspace rights should be clarified,and a systematic airspace rights distribution system should be constructed.In the process of improving the supporting guarantee mechanisms for the low-altitude economy,the positive role of law in resolving resource allocation conflicts should be leveraged to promote the high-quality development of the low-altitude economy.
