摘要
针对当前国际上太空交通管理无法可依、有法难依的现实问题,采用法理分析、比较研究等方法审视现行国际太空法规存在的缺陷和不足,探讨太空交通法规构建原则,研究太空交通法规构建方法路径。研究发现:当前国际太空法规在太空交通领域适用存在基本法律概念不清、责任机制不完善、调节主体范围受限等问题,未来推动太空交通法规构建应注意把握平等、公平、和平、可持续利用、保护善意、共同但有区别等原则,可采取对现有国际法规修订完善、对其他国际法规“移植”太空适用、支持太空交通领域“软法”建设、开展国内太空交通法规实践等方法,解决当前太空交通领域无法可依和有法难依的现实难题。
In response to the current reality of lack of legal basis and difficulty in complying with laws in international space traffic management,this study adopts methods such as legal analysis and comparative research to examine the shortcomings and deficiencies of current international space regulations,explore the principles of constructing space traffic regulations,and study the legal path for constructing space traffic regulations.It has been found that there are problems with the application of current international space regulations in the field of space transportation,such as unclear basic legal concepts,incomplete liability mechanisms,and limited scope of regulatory entities.In promoting the construction of space transportation regulations in the future,attentions should be paid to principles such as equality,fairness,peace,sustainable use,protection of goodwill,and common but differentiated approaches.To address the current challenges of lacking legal basis or facing difficulties in adhering to laws in the space traffic domain,we can adopt methods such as revising and improving existing international regulations,"transplanting"the application of other international regulations to space,supporting the construction of"soft law"in the field of space transportation,and carrying out domestic practice of space transportation regulations to solve the current practical problems.
