摘要
随着区块链技术的快速发展,其在司法领域的应用逐渐深入,尤其是在民事电子证据的真实性保障与审查机制方面展现出独特优势。本文以区块链赋能下民事电子证据规则的重构与适用为研究对象,旨在探索真实性保障与审查机制的优化路径。通过文献分析、案例研究及比较法研究,提出基于区块链的电子证据审查规则与司法适用框架。结果表明,区块链技术可显著提升电子证据的真实性与可信度,为完善我国电子证据规则提供理论支持与实践参考。研究还结合国内外司法实践,提出具体适用建议,以推动区块链技术在司法领域的深度融合与应用。
With the rapid development of block chain technology,its application in the judicial field has gradually deepened,es-pecially demonstrating unique advantages in the authenticity assurance and examination mechanism of civil electronic evidence.This paper takes the reconstruction and application of civil electronic evidence rules empowered by block chain as the research ob-ject,aiming to explore the optimization path of authenticity assurance and examination mechanism.Through literature analysis,case study and comparative law research,it proposes an electronic evidence examination rule and judicial application framework based on block chain.The results show that block chain technology can significantly improve the authenticity and credibility of e-lectronic evidence,providing theoretical support and practical reference for improving China’s electronic evidence rules.Com-bined with domestic and foreign judicial practices,the research also puts forward specific application suggestions to promote the in-depth integration and application of block chain technology in the judicial field.
