摘要
中国香港国安法实施以来,成效显著,香港地区从由乱到治,迈向由治及兴。香港特别行政区法院在其判例法中发展了一套关于如何解释和适用中国香港国安法的法理原则;2024年3月,香港特别行政区立法会又通过了《维护国家安全条例》,使中国香港基本法第23条的规定得以落实。本文回顾中国香港国安法的判例法的发展,并探讨《维护国家安全条例》作为中国香港本地立法与中国香港国安法的衔接和互补关系。
With the implementation of the Hong Kong of China National Security Law,it shows remarkable effectiveness,facilitating Hong Kong’s region transition from chaos to order,and from order to prosperity.The courts of the Hong Kong Special Administrative Region have developed a set of jurisprudential principles in their case law on how to interpret and apply the Hong Kong of China National Security Law.In March 2024,the Legislative Council of the Hong Kong Special Administrative Region passed the Safeguarding National Security Ordinance,thereby make the provisions of Article 23 of the Hong Kong of China Basic Law take effect.This article reviews the development of case law related to the Hong Kong of China National Security Law and explores how the Safeguarding National Security Ordinance as local legislation dovetails with and supplements the Hong Kong of China National Security Law.
