摘要
刑事规制扩张和行政规制不足的“刑扬行抑”现象,是公共风险法律规制领域长期存在的痼疾,不但对“违法—犯罪”二元体系造成冲击,而且给社会的良性发展带来诸多副作用。为从根本上矫治“刑扬行抑”现象,宜将“行主刑辅”模式确立为公共风险法律规制的理想类型。对于“行主刑辅”模式的基本内涵,可以从适用顺位、适用频次和适用强度上进行界定,而寻求公法秩序的均衡之约、打造以行政权为主导的基本权利保障体系、回应中国式法治现代化的治理转向则构成“行主刑辅”模式在价值、规范、实践三个向度的支撑理据。“行主刑辅”模式的体系化建构应采用“三阶式”策略:观念纠偏是首要前提,旨在贯彻以“报应”为主的综合目的论;实体融贯是核心举措,旨在达致行刑责任一体化匹配;程序补强是调节枢纽,旨在细化行刑反向衔接流程设置。
The phenomenon that criminal regulation expands while administrative regulation remains insufficient has been a longstanding issue in the field of legal regulation of public risks.It not only disrupts the binary system of illegality and crime,but also brings about numerous side effects for the healthy development of society.To fundamentally correct the phenomenon,the"administrative law guiding and criminal law supplementing"model should be established as the ideal type for legal regulation of public risks.The basic connotation of the model can be defined in terms of its application priority,frequency,and intensity.Seeking a balanced approach to public law order,creating a protection system of basic rights centered on administrative power,and responding to the governance shift in Chinese path to modernization of the rule of law constitute the supporting rationale in the three dimensions of value,norms,and practice for this model.The systematic construction of the"administrative law guiding and criminal law supplementing"model adopts a"three-stage"strategy.Conceptual rectification is the primary prerequisite,aiming to implement a retributive,comprehensive teleological approach.Substantive integration is the core measure,aiming to achieve a unified match between criminal and administrative responsibilities.Procedural reinforcement is the regulatory hub,aiming to refine the reverse connection process between administrative law and criminal law.
