摘要
《刑法修正案(十一)》将最低刑事责任年龄下调,并通过设置双重限制要件构建了审慎的司法规制体系:其一为程序性要件,即需经最高人民检察院核准追诉;其二为实体性要件,包括行为人年龄、行为性质及社会危害性等三项核心标准。然而,该条款仍存在规范模糊性与适用困难等问题,一方面,实体认定要素的抽象性容易导致司法实践陷入机械适用或过度扩张的双重误区;另一方面,立法者意图与司法解释之间的衔接机制尚未完善,可能引发法律解释间的冲突与裁判尺度的分歧。于是当前亟须细化实体要件的认定标准,明确各要素的具体内涵与适用边界,同时强化立法与司法的协同,确保法律适用的统一性与处理低龄未成年人犯罪问题的精准性。
ion of entity identification elements easily leads to the double misunderstanding of mechanical application or excessive expansion in judicial practice.On the other hand,the connection mechanism between legislators'intention and judicial interpretation is not perfect,which may lead to conflicts between legal interpretations and differences in judgment standards.Accordingly,there is an urgent need to refine the identification standards of substantive elements,clarify the specific connotation and applicable boundaries of each element and strengthen the coordination between legislation and justice to ensure the uniformity of law application and the accuracy of dealing with juvenile delinquency.
