摘要
为他人提供“翻墙”软件行为的法律定性在实务界和理论界分歧巨大,针对其定性主要有“提供侵入、非法控制计算机信息系统程序、工具罪说”“非法经营罪说”“拒不履行信息网络安全管理义务罪说”等不同观点。但无论从“翻墙”软件的技术原理来看,还是从行为的构成要件符合性来分析,为他人提供“翻墙”软件行为很难与提供侵入、非法控制计算机信息系统程序、工具罪以及非法经营罪的构成要件完全相吻合。事实上,为他人提供“翻墙”软件行为可能构成拒不履行信息网络安全管理义务罪,其关键在于行为人是否违反“信息网络安全管理义务”,未取得增值电信业务经营许可不符合“信息网络安全管理义务”的内涵。
There is a considerable divergence in the legal characterization of providing others with software for bypassing internet firewalls among both the practical and theoretical circles.The main viewpoints revolve around"the crime of providing programs and tools for intruding into and illegally controlling computer information systems","the crime of illegal business operations"and"the crime of refusing to fulfill the obligation of information net security management".However,whether from the perspective of technical principle of the software for bypassing internet firewalls or from the perspective of analyzing the conformity of the constituent elements of the act,the act of providing others with such software is difficult to fully align with the constituent elements of the crime of providing programs and tools for intruding into and illegally controlling computer information systems or the crime of illegal business operations.In fact,the act of providing others with software for bypassing internet firewalls may be considered as the crime of refusing to fulfll the obligation of information net security management.The key consists in whether the actor violates the"obligation of information net security management",and not obtaining the license for value-added telecommunications business operations does not conform to the connotation of the"obligation of information net security management".
