摘要
大数据赋能行政违法行为检察监督能够提升治理效能,但亦有引发检察权运行失范、权力结构失衡与权利保障弱化的法治偏移风险。造成法治偏移的成因包括过度依赖数据闭环与算法决策导致法律判断被技术标准替代,制度规则滞后与法律授权模糊引发的权力扩张,以及公益优先逻辑下个体权利空间被压缩。针对上述问题提出体系化的纠正路径:在价值维度,确立人机协同与协作监督原则,明确技术辅助的监督定位;在程序维度,构建个案依附性审查与公共利益门槛验证的双轨制框架,遏制检察权行使泛化;在数据治理维度,建立代位数据处理的双重限制机制,通过数据使用的一般限制与原始目的的场景约束,推动数据处理从“主体权限”向“行为正当性”的转型。
While empowering prosecutorial supervision of administrative illegal acts with big data enhances governance efficiency,it simultaneously triggers risks of deviation from the rule of law characterized by abnormal prosecutorial power operation,imbalanced power structures,and weakened rights protection.The causes of such deviation include the substitution of legal judgment by technical standards due to excessive reliance on data closed-loops and algorithmic decision-making,power expansion stemming from lagging institutional frameworks and ambiguous legal authorization,and the compression of individual rights under public interest primacy.To address these issues,this study proposed a system aticcorrection pathway.In the value dimension,principles of human-machine collaboration and cooperative supervision are established to redefine technology as an auxiliary tool.In the procedural dimension,a dual-track framework integrating case-dependent review and public interest threshold verification is designed to prevent the overgeneralization of prosecutorial authority.In the data governance dimension,a dual-restriction mechanism for surrogate data processing is introduced,combining general data usage constraints with scenario-bound original-purpose limitations,thereby transitioning governance logic from"entity authority"to"behavioral legitimacy".
