摘要
基于网络空间的开放性、动态性、虚拟性等特征,传统法律在治理问题上争议不断,各国本着不同立场采用不同的治理模式,建构的网络空间治理规则也存在缺乏共识的情况。与此同时,网络暴力、网络恐怖主义、网络犯罪等问题日益凸显,网络空间治理规则的完善刻不容缓。而从法学视角探究网络空间治理规则的完善及创新思路,能够为网络空间的现代化治理提供必要的抓手。文章结合网络空间形成对国际法规则的影响,法学视角下网络空间治理规则,分析网络空间治理问题,提出完善及创新策略。
With the iterative advancement of network information technology,the internet has evolved from a mere communication tool into a fully realized cyberspace,completing its transformation into a spatial entity.Today,cyberspace has become a critical domain for human survival and development.Due to its open,dynamic,and virtual nature,traditional legal frameworks face ongoing disputes in governance issues.Countries adopt diverse governance models based on differing stances,resulting in a lack of consensus in the constructed rules for cyberspace governance.Meanwhile,challenges such as cyber warfare,cyber terrorism,and cybercrime are becoming increasingly prominent,making the improvement of cyberspace governance rules an urgent priority.Exploring pathways for the refinement and innovation of these rules from a legal perspective can provide essential leverage for the modern governance of cyberspace.This article examines the impact of cyberspace formation on international legal norms,analyzes current governance issues from a legal standpoint,and proposes strategies for enhancement and innovation.
