摘要
随着生成式人工智能技术的突破性发展,AI生成式作品的著作权归属问题成为法学与数据产业交叉领域的核心争议。本文从物权、著作权及价值三大维度展开分析:在物权孳息理论框架下,生成物作为人工智能运作的天然孳息,其著作权归属于投入核心生产要素的研发者;通过演绎作品规则重构,确立研发者对训练数据二次创作的法定获权基础;并从价值平衡视角出发,进一步探讨各方利益协调的可能路径。在此基础上,提出“要素贡献分层确权”模型,构建以灵感主导性、数据贡献值、资本投入度为基准的三阶要素确权体系。研究强调,在现行法律框架下,应当将研发者列为权利分配主体之一,通过三维度确权机制与要素贡献评估制度,实现技术伦理与法律逻辑的有机统一。
With the breakthrough development of generative artificial intelligence technology,the issue of copyright ownership of AI generated works has become a core dispute in the intersection of law and data industry.This article analyzes from three dimensions:property rights,copyright,and value.Under the framework of property rights and interest theory,the copyright of generated products,as natural fruits of artificial intelligence operation,belongs to the developers who invest in core production factors;By reconstructing the rules of deductive works,establish the legal basis for developers to obtain rights for secondary creation of training data;And from the perspective of value balance,further explore the possible paths for coordinating the interests of all parties.On this basis,a"factor contribution hierarchical certification"model is proposed to construct a three-level factor certification system based on inspiration dominance,data contribution value,and capital investment degree.The study emphasizes that under the current legal framework,researchers should be listed as one of the rights allocation subjects,and the organic unity of technological ethics and legal logic should be achieved through a three-dimensional property rights confirmation mechanism and element contribution evaluation system.
