摘要
以道德对公职人员隐私权进行限制,在我国古代和近现代西方国家都进行了实践,积累了经验。在依法治国和以德治国的今天,道德对公职人员隐私权限制有利于提升公职人员对党和人民的忠诚度,净化公职人员私生活圈子,促进清正廉洁优良作风的形成。道德限制公职人员隐私权是法律限制的基础,通过夯实道德教育,发挥道德限制隐私权优势;推进道德立法,明确隐私权受限边界;完善道德追责,加强隐私权受限监督;引导公职人员的隐私期待,培养隐私权受限意识等方法,更好实现公职人员隐私权道德限制的目标。
Moral restrictions on the privacy rights of public officials have been practiced in ancient China and modern Western countries,accumulating relevant experience.In today's era of ruling the country by law and ruling the country by virtue,moral restrictions on the privacy rights of public officials are conducive to enhancing their loyalty to the Party and the people,purifying their private life circles,and promoting the formation of a clean and upright work style.Moral restrictions on the privacy rights of public officials are the basis of legal restrictions.By consolidating moral education and giving full play to the advantages of moral restrictions on privacy rights;promoting ethical legislation and clarifying the boundaries of restricted privacy rights;improving moral accountability and strengthening supervision over restricted privacy rights;guiding public officials’privacy expectations and cultivating their awareness of restricted privacy rights,we can better achieve the goal of moral restrictions on their privacy rights.
