摘要
道德的法律强制并非一个现代问题,早在亚里士多德的论述中便已提出借法律塑造公民德性,并在阿奎那的承继与修正后形成了道德立法的核心传统。詹姆斯·斯蒂芬首次较为系统地提出了刚性的“法律道德主义”理论;德弗林勋爵在与哈特的论战中也不谋而合地提出一种柔性版本,成为后世道德的法律强制的基本范式。经由乔治的调和,法律道德主义在新自然法背景下重焕生机,在多元至善主义与尊重个人自治之间找寻到了平衡点。但各式理论都有缺陷。鉴于此,合理的道德立法就要做到谨慎选择被强制的道德类型,运用多元的立法模式,且时刻践行辅助性原则。
The legal enforcement of morality is not a modern issue;it was already addressed in Aristotle's discussions about shaping citizens'virtue through law,and after being inherited and modified by Aquinas,it formed the core tradition of moral legislation.James Stephen was the first to systematically propose a rigid theory of“legal moralism”;Lord Devlin,in his debate with Hart,coincidentally proposed a more flexible version,which became the basic paradigm for the legal enforcement of morality in later generations.Through George's reconciliation,legal moralism has been revitalized in the context of new natural law,finding a balance between pluralistic perfectionism and respect for individual autonomy.However,all kinds of such theories faced their challenges.In view of this,reasonable moral legislation must carefully choose the types of morality to be enforced,employ diverse legislative models,and constantly practice the principle of subsidiarity.
