摘要
人工智能生成内容是艺术融合科技的结晶,能够通过作品规范要件的考察。结合艺术原理可理解创作的随机特质,以摄影为参照回顾版权史,创作的概念张力也能适应人工智能的技术更迭。在人工智能生成内容的语境下,思想表达二分法的适用存有争议,明确真正的评价对象则可化解难题。应当坚持以造型艺术为核心的保护逻辑,区分看待提示词与生成图片。应当从行为引导生成式人工智能向善发展,强化人工智能生成内容的可信赖度,推动其和谐融入创作圈层。
AI-generated content is the result of the fusion of art and technology,which can meet the objective standards of originality through the examination of the work's formal requirements.By combining principles of art,the random nature of creation can be understood.Looking back at the history of copyright through the lens of photography,the concept of creation can adapt to the technological evolution of AI.The use of the idea-expression dichotomy in Al-generated content remains controversial,but clarifying the true object of evaluation can resolve this issue,Prompts and generated content should be viewed separately,adhering to a protection logic that starts from the form of expression and moves inward.To ensure the orderly development of AI art,it is necessary to accept new quality productive forces,guide generative AI toward positive development through behavioral regulation,enhance the trustworthiness of Al-generated content,and promote its harmonious integration into the creative community.
