摘要
新质生产力作为先进生产力的崭新形态,已成为推动经济发展的关键力量,而专利开源作为新兴专利运用模式,引发了广泛关注。文章介绍了新质生产力的提出、专利开源的发展和现状,并且在促进技术共享与创新、优化资源配置提升品牌影响力、形成专利防御、作为专利转化运用的有效手段等方面分析了新质生产力下专利开源赋予的机遇,同时针对知识产权保护与利益平衡、法律风险、技术依赖等问题指出了专利开源带来的挑战。通过特斯拉和丰田的专利开源案例对比,得出企业在实施该策略时需综合考量技术成熟度、市场需求和政策环境等因素。
As a new form of advanced productivity,new quality productivity has become a key driver for economic development.Patent open source,as an emerging patent utilization model,has attracted extensive attention.This paper introduces the proposal of new quality productivity,the development and current status of patent open source.It also analyzes the opportunities brought by patent open source under new quality productivity in aspects such as promoting technological sharing and innovation,optimizing resource allocation and enhancing brand influence,forming patent defense,and serving as an effective means for patent transformation and application.Meanwhile,it discusses the challenges posed by patent open source,including intellectual property protection and interest balance,legal risks,technological dependence,and other issues.Through a comparative case study of patent open source strategies by Tesla and Toyota,it is concluded that enterprises need to comprehensively consider factors such as technical maturity,market demand,and policy environment when implementing this strategy.
