摘要
秦汉简牍所见“遝”相关文书,均用于相关人员、档案等不在审理地的狱案处理中,“遝”在此类文书中解释为“相及”“论及”比较合适,此类文书大都不能归为“遝书”。岳麓书院藏秦简所见“征书”应是此类治狱程序的适用文书,表示将档案文书或狱案相关人员由一地征至另一地。征书应由正文和附件组成,附件部分记录征召者的具体身份信息等内容。秦末汉初,“遝”开始逐渐有“逮捕”的意思,从“遝书”出现的具体语境看,其表达的主要含义还是侧重于控制和逮捕,故把“遝书”理解为逮捕文书更为合适。另外,秦汉治狱过程中,“召”亦有从一地征至另一地之意,但其可能仅适用于口头传唤,或者是相对柔和中性的场景。
In the documents related to“Ta”(遝)found in Qin and Han bamboo slips,all are used in handling legal cases where relevant personnel or archives are not located at the trial site.In such documents,“Ta”is appropriately interpreted as“involving”or“relating to”,and most of these documents cannot be categorized as“Ta Shu”(遝书).“Zheng Shu”(征书)mentioned in the Qin bamboo slips collected by Yuelu Academy should be the applicable document in such judicial procedures,referring to summoning archival documents or personnel related to a legal case from one place to another.A“Zheng Shu”should consist of a main text and an appendix,where the appendix records specific identity information of the summoned individuals,etc.At the end of the Qin Dynasty and the beginning of the Han Dynasty,“Ta”(遝)gradually took on the meaning of“arrest”.Based on the specific context in which“Ta Shu”appears,its core meaning focuses on control and arrest,so it is more appropriate to interpret“Ta Shu”as an arrest document.In addition,during the judicial process of the Qin and Han dynasties,“Zhao”(召)also meant summoning someone from one place to another,but it may only apply to oral summons or relatively mild and neutral scenarios.
