摘要
作为算法治理体系的重要组成部分,算法备案主要存在备案性质尚不明确、备案程序有待完善以及规制主体、规制工具单一的问题。有必要从过程论视角,综合运用规制理论、规制工具和行政行为理论,勾勒出算法备案的规制框架及实现路径。在备案前,实现规制理论的分类应用。在备案时,明晰算法备案性质、完善备案程序。在备案完成后,由多元主体参与算法合作规制。
As an important part of the algorithm governance system,algorithm filing mainly has problems such as unclear filing nature,procedures to be improved,and single regulatory subjects and tools.It is necessary to outline the regulatory framework and implementation path of algorithm filing from a process perspective and comprehensively apply regulatory theory,regulatory tools and administrative act theory.Before fling,realize the classifed application of regulatory theory.When filing,clarify the nature of algorithm filing and improve the fling procedures.After the filing is completed,multiple subjects participate in the cooperative regulation of algorithms.
