摘要
“农村土地流转”从字面上理解,是指农民集体所有和国家所有的农村地区和城市郊区的农用地和非农用地的所有权和使用权流转的行为,以及农用地转为非农用地和非农用地转为农用地的行为。为了与其他相关概念进行区分并避免使用上的混乱,“农村土地流转”应在狭义上界定,即等同于农村土地承包经营权的流转,是指农村和城市郊区农民集体所有且由农户承包经营的土地,在坚持农民集体所有的前提下,农户保留承包权,按照依法、自愿、有偿的原则,把经营权转移给其他农户或经济组织的行为。当前农村土地流转面临三方面机制障碍:以差序格局为特征的熟人社会限制了农民流转土地的范围和收益;土地流转供需机制不健全严重制约了农村土地流转的进一步发展;金融支持不足极大地束缚了土地流入方的经营规模。因此,应当从加强农村土地流转政策宣传、深化农村土地流转组织支持、改善对农民的金融支持等方面破解机制障碍,推进农村土地流转。
"Rural land transfer"literally refers to the transfer of ownership and use rights of agricultural and non-agricultural land in rural and suburban areas owned collectively by farmers and by the country,as well as the conversion of agricultural land to non-agricultural land and of non-agricultural land to agricultural land.In order to differentiate from other related concepts and to avoid confusion,“rural land transfer”should be defined in a narrower sense,i.e.,equivalent to the transfer of rural land contracting rights,which refers to land collectively owned by peasants in rural areas and urban suburbs and contracted by farmers,with farmers retaining the contracting rights under the premise of collective ownership by farmers.In accordance with the principle of legality,voluntariness and compensation,the management right is transferred to other farmers or economic organization.Rural land transfer is faced with three institutional obstacles:the acquaintance society characterized by a differential order pattern restricts the scope and benefits of land transfer for farmers,the inadequate supply and demand mechanism of land transfer seriously restricts the further development of rural land transfer,and the insufficient financial support greatly restricts the operation scale of land inflow sides.Mechanism barriers should be broken down by strengthening the publicity of rural land transfer policies,deepening the support of rural land transfer organizations,and improving financial support for farmers,in order to promote rural land transfer.
