摘要
文化多样性是人类社会可持续发展的根基,也是非物质文化遗产保护的目标与核心价值。受全球化与现代化浪潮的影响,非物质文化遗产的流失及知识产权利益冲突问题日益严峻,对非物质文化遗产的传承与保护、维护世界文化多样性提出挑战。中国与东盟在非物质文化遗产知识产权保护方面有着共同的利益和目标,在中国—东盟区域合作深化发展的过程中,构建高水平的知识产权协调与合作机制、建立非物质文化遗产知识产权保护制度至关重要。应围绕思想基础、实体规则、程序保障进行全方位的制度设计。
Cultural diversity is both the foundation of sustainable human development and the core value and objective of protecting intangible cultural heritage(ICH).However,under the pressures of globalization and modernization,the loss of ICH and conflicts over related intellectual property(IP)rights have become increasingly severe,posing significant challenges to cultural preservation and diversity.China and ASEAN share common interests and goals in safeguarding the intellectual property of intangible heritage.As regional cooperation deepens,it is crucial to establish a high-level coordination and collaboration mechanism for IP protection,along with a sound legal and institutional framework for ICH-related IP rights.A comprehensive system design should be developed,focusing on three core aspects:ideological foundation,substantive legal rules,and procedural safeguards.
