摘要
平台经济监管常态化是基于我国现实状况和平台经济发展规律作出的选择,内蕴历史逻辑与实践逻辑的辩证统一。如何实现平台经济监管的常态化是我国经济发展过程中无法规避的课题。回应性监管理论与我国平台经济常态化监管在某些方面存在相通之处,其对构筑本土化的常态化监管方案具有一定的启发,即构建“协同式监管+分类式监管+阶梯式监管”的监管框架。其一,在监管主体层面,在扩充监管主体的基础上,借助目标兼容与信任构建激发多元主体协同监管热情,且通过协同规则和功能等实现多元主体协同监管;其二,在监管客体层面,以内生创新为视角将平台划分为价值创造型和价值增值型平台,实行差别化监管,前者关注技术竞争,后者聚焦价格竞争;其三,在监管工具层面,构建激励性和约束性监管工具金字塔,在此基础上考察平台经济的风险、情节等因素,结合比例原则,渐进、动态地选择适宜工具。
The normalization of platform economy regulation is a choice made based on the realities of our country and the developmental laws of the platform economy,embodying a dialectical unity of historical and practical logic.Achieving the normalization of platform economy regulation is an unavoidable topic in the economic development process of our country.The responsive regulatory theory shares commonalities with the normalization of platform economy regulation in certain aspects,offering insights for constructing localized regulatory schemes.This involves creating a regulatory framework of“coordinated regulation+differentiated regulation+tiered regulation.”Firstly,at the level of regulatory subjects,expanding the regulatory body and fostering the enthusiasm of multiple subjects for collaborative regulation through goal compatibility and trust,and achieving this through collaborative rules and functions.Secondly,at the level of regulatory objects,platforms are divided into value-creating and value-enhancing types from the perspective of endogenous innovation,implementing differentiated regulation,where the former focuses on technological competition and the latter on price competition.Thirdly,at the level of regulatory tools,constructing a pyramid of incentive and constraint regulatory tools,examining factors such as risks and scenarios in platform economies,and selecting appropriate tools progressively and dynamically in accordance with the principle of proportionality.
