摘要
加强数字政府建设是党和国家的重要战略。数字政府在履行管理与服务职责过程中产生海量政府数据。政府数据在开放利用以提升社会治理水平的同时,产生严重隐私问题,引发社会担忧,影响社会稳定,威胁国家安全,亟须构建符合中国国情的政府数据隐私管理方案,平衡政府数据开放利用与个人隐私权益保障的矛盾需求。本文通过梳理政府数据生命周期,探索政府数据生命周期不同阶段的隐私形态及其计量方法,分析政府数据隐私风险发生机理,实现政府数据隐私风险计量;在此基础上,构建政府数据分级保护机制,形成政府数据隐私风险管理理论体系,以期解决我国政府数据隐私风险管理的现实难题与痛点,全面提升我国政府数据隐私治理水平。
Digital government is an important strategy for China,playing a crucial role in enhancing national governance.As digital government generates large amounts of government data while providing management and services to society,the government data can be used in a wide range of areas.However,it also introduces privacy risks which have become a major obstacle to the opening and use of government data.The conflict between the opening of government data and privacy protection remains unresolved.First,both academia and industry treat privacy risk as a deviation between the operation result of government data and the expected protection effect of privacy protection laws.This view cannot reflect the nature of government data privacy risk.Second,there is a disconnect between academia and industry regarding the privacy definition.This phenomenon is reflected in the difference between the subjects of privacy definition in academia and practice.Different laws and standards have different implications for privacy definition.Third,while existing laws and standards implement a hierarchical privacy protection policy,there is no scientific basis for privacy classification.This makes it difficult to implement the hierarchical privacy protection policy.In general,existing studies have not considered the privacy characteristics at different stages of the government data lifecycle,nor have they produced systematic results.This paper analyzes the privacy characteristics and measurement methods at different stages of the government data lifecycle.It proposes an algorithm to convert government data privacy value into government data privacy risk value according to the occurrence mechanism of government data privacy risk.On this basis,the government data hierarchical protection mechanism is constructed.The authors aim to present this approach as an effective solution for managing government data privacy risks,ultimately improving the level of government data privacy governance in China.
