摘要
作为一种法定判决方式,当前行政处罚变更判决呈现的独有特点,包括所涉领域广泛、被告主体多元、适用条件尚不统一、适用标准差异较大、判决方式多样、实质性解决争议仍有难度等。审判实践反映出行政处罚变更判决面临着理论和实践的双重困境。为此要加强行政处罚变更判决的理论研究和实践探索,从明确功能定位、厘定适用范围、确定适用条件、统一适用标准、规范适用方式、增强适用效果等方面着手,推动行政处罚变更判决更加成熟和定型。
As a statutory form of judicial judgment,the current administrative punishment modification judgments exhibit unique characteristics,including involvement in a wide range of fields,diverse defendants,inconsistent application conditions,significant variations in applicable standards,diverse judgment methods,and ongoing difficulties in substantively resolving disputes.Judicial practice has revealed that administrative punishment modification judgments face dual dilemmas in theory and practice.Therefore,it is necessary to strengthen theoretical research and practical exploration.This should be approached by clarifying the functional positioning,delineating the scope of application,determining the applicable conditions,unifying the applicable standards,standardizing the applicable methods,and enhancing the effectiveness of application in order to promote the maturity and standardization of administrative punishment modification judgments.
