摘要
该研究对我国含麻制剂产业链各环节及法律法规中所出现的问题进行分析总结,提出合理建议,为更好地完善我国含麻制剂监管,防范含麻制剂的流失,减少相关犯罪,保障人民安全提供参考。通过检索国内文献数据库、新闻报道中有关的报道与政策等,了解我国对含麻制剂管制现状。整理分析后发现我国对含麻制剂在实际监管过程中存在一些问题,如含麻制剂法律法规不完善;麻黄草种植广泛,原料种植环节监管难度大;生产企业员工缺乏法律意识,行为不规范;销售终端流向不明,新型运输方式复杂;医疗机构含麻制剂处方开具量大,防控体系不完备等。建议从提升相关法律法规层次,规范麻黄草种植;提高含麻制剂生产企业准入门槛,培养员工的高度责任感;建立智慧药房,运用互联网优势打击犯罪,并通过建立医疗机构含麻制剂药品中央数据库等方式加强对含麻制剂的监管。
To analyze and summarize the problems in the industrial chain,laws and regulations of hemp-containing preparations of China,and to put forward reasonable suggestions to provide references for better improving the supervision of hemp-containing preparations in China,preventing the loss of hemp-containing preparations,reducing related crimes,ensuring people’s safety.After sorting out and analyzing,it is found that there are some problems in the actual supervision process of hemp containing preparations in China,such as imperfect laws and regulations on hemp containing preparations.Ephedra is widely planted,and it is difficult to supervise the planting link of raw materials.Production enterprise employees lack legal awareness,behavior is not standard.The direction of sales terminal is unknown,and the new mode of transportation is complicated.Large prescription volume of hemp containing preparations in medical institutions,incomplete prevention and control system,etc.It is suggested that in the aspect of upgrade the relevant laws and regulations to standardize the planting of Ephedra.Raise the entry threshold of hemp-containing preparations production enterprises and cultivate employees’high sense of responsibility.Establish intelligent pharmacies,use the advantages of Internet to crack down on crime and establish a central database of narcotic preparations in medical institutions to strengthen the supervision of hemp-containing preparations.
