摘要
建构法治化营商环境是推进经济高质量发展的重要支撑。在现行实践与试行立法双轮驱动下,营商环境建设在信用调解机制、营商环境评价体系以及法治政府建设等方面仍存在一些问题有待解决。优化我国法治化营商环境应多措并举:通过拓宽经费保障渠道、限缩“失信泛化”惩戒等举措,完善信用调解机制;通过构建独立第三方评价主体、实行行业差异化评价标准、搭建“数智化”信息联通平台等措施,完善营商环境评价体系;通过改善地方制度环境、加强行政执法监督力度等办法,完善法治政府建设,从而适应经济发展新态势。
Building a law-based business environment has become an important support of promoting high-quality economic development.Under the dual drive of current practice and trial legislation,there are still some problems to be solved in the construction of the business environment in aspects such as the credit mediation mechanism,the business environment evaluation system and the construction of a law-based government.Multiple measures should be taken to optimize the law-based business environment in China:The credit mediation mechanism can be improved by expanding funding guarantee channels,and limiting the punishment of"the generalization of dishonesty";The business environment evaluation system can be improved by establishing independent third-party evaluation entities,implementing regional industry differentiation standards,and building a"digital"information communication platform;The rule of law government should be improved by improving the local institutional environment and strengthening administrative law enforcement supervision,thus adapting to the new situation of economic development.
