摘要
自然资源统一确权登记是自然资源资产产权制度改革的基础性制度,在公示物权秩序的传统功能之外,还承接了生态保护与监管的全新制度目标。双重制度目标引发登记单元划定标准不确定、登记客体法律性质含混等问题,危及确权登记制度的有效发挥。基于自然资源的生态价值对经济价值的实现存在嵌入性的制约关系,自然资源统一确权登记应定位于通过重识各资源要素间生态关联而进行的空间维度的整体性登记。因此,在整合现行不动产登记制度的基础上,有必要释明并完善自然资源统一确权登记在登记功能(生态监管-权属确认)、登记客体(生态空间-资源要素)、运行逻辑(外部行政监管-所有权自我约束)等方面的嵌套式构造,以实现自然资源统一确权登记的双重目标。
As a basic system for the reform of the property right system of natural resources assets,the unified confirmation and registration of natural resources rights has also taken on the brandnew system goal of ecological protection and supervision in addition to the traditional function of publicizing the real right order.The dual purpose of the system is to cause problems such as uncertainty of the demarcation standard of the registration unit and vagueness of the legal nature of the registration object,thus jeopardizing the effectiveness of the system for unified confirmation and registration.Based on the embeddedness of the ecological value of natural resources in the realization of economic values,unified confirmation and registration should be located in the overall registration of spatial dimensions by re-recognizing the ecological relationship between various resource elements.Therefore,on the basis of integrating the current real estate registration system,it is necessary to clarify and improve the nested structure of the unified confirmation and registration of natural resources in terms of registration function(ecological supervision-ownership confirmation),registration object(ecological space-resource element),and operation logic(external administrative supervision-ownership self-restraint),so as to successfully realize the dual goal of confirmation and registration of natural resources rights.
