摘要
《孟子》是人权理念比较鲜明和突出的儒家经典。厘清中华传统文化与现代人权的关系,明确传统文化中的人权形态,基于普遍性和特殊性两个视角具体化人权理念识别标准,从而构建传统文化人权理念的判断逻辑,这是研究《孟子》人权理念的方法论前提。在渐次析取《孟子》人权理念的基础上,构建“价值基座—基本原则—实践路径”的理念体系,为理解《孟子》人权理念提供一个研究范式。《孟子》中人权理念的时代局限性主要在于人权的主体平等不彰、民主基础薄弱和法治保障缺失,其进步意义在于提供跨时代、跨区域的宝贵思想资源。勘明其时代局限性、阐释其跨时代文化意义,对探寻当代中国人权观的历史根基、增强中国特色人权发展道路的自信、构建中国自主人权话语体系具有重要意义。
The Mencius is a Confucian classic with a distinct and prominent ideas of human rights.Clarifying the relationship between Chinese traditional culture and modern human rights,defining the form of human rights in traditional culture,and concretizing the criteria for identifying human rights concepts from the perspectives of universality and particularity are the methodological prerequisites for studying the ideas of human rights in the Mencius.Based on a progressive analysis of the human rights idea in the Mencius,an ideological system with the elements of"value base-basic principles-practical path"is formed to provide a paradigm for understanding the human rights idea in the Mencius.The main limitations of the human rights idea in the Mencius are the lack of prominent subject equality,weak democratic foundations,and the absence of legal safeguards.Its progressive significance lies in providing valuable ideological resources across eras and regions.Identifying its limitations and developing its cross-era cultural significance is important for exploring the historical roots of contemporary Chinese human rights ideology,enhancing confidence in the Chinese path of human rights development,and constructing a Chinese human rights discourse system.
