摘要
在持续不断地高压打击下,我国暴力恐怖犯罪的势头已基本得到抑制,但是恐怖主义作为最突出的非传统安全风险,仍需对其保持高度警惕。基于当前反恐情势,应当以总体国家安全观为总遵循,树立以安全为中心、以预防为核心、以教育为重心的中国式反恐刑法观。在中国式反恐刑法观的指引下,积极推动反恐刑法的系统展开。完善反恐刑法与反恐行政法的一体化,强化反恐刑法与反恐刑事诉讼法的一体化,推进国内反恐刑法与国际反恐刑法的一体化。同时,结合当下的反恐情势和立法实践,还需进一步完善反恐刑法立法,当务之急是在刑法中增设实施恐怖活动罪。
Terrorist crimes in China have been largely suppressed through sustained efforts,but as one of the most prominent non-traditional security risks,they are still a big concern.The conceptual framework should take the holistic approach to national security the general guideline of counterterrorism,and security as a core concept,prevention as a key measure and education as a major task.Under the conceptual guidance anti-terrorism criminal law,the three-dimensional mode should be actively promoted.In terms of external relations,the integration of anti-terrorism criminal law and anti-terrorism administrative law should be improved;in terms of internal relations,the anti-terrorism criminal law and anti-terrorism criminal procedure law should be vertically strengthened,and the domestic anti-terrorism criminal law and international anti-terrorism criminal law should be horizontally linked.To this end,it is necessary to further improve counter-terrorism criminal law legislation and to add the crime of committing terrorist activities to the Criminal Code.
